Selman v. Cobb County School District - [Decision by Clarence Cooper, United States District Judge, Jan. 13, 2005] – United States District Court for the Northern District of Georgia, Atlanta Division [Updated: December 17, 2005]
“Plaintiffs Jeffrey Michael Selman [et al]…contend that the sticker [a caveat about evolution…] violates the Establishment Clause of the First Amendment, as incorporated in the Fourteenth Amendment…. (p. 1 of 26)
“In addition to the Establishment Clause challenge, Plaintiffs assert that the Sticker violates Article I, Section II, Paragraph VII of the Constitution of the State of Georgia. This provision states the following: ‘No money shall ever be taken from the public treasury, directly or indirectly, in aid of any church, sect, cult, or religious denomination or of any sectarian institution.’” (p.24 of 26)

McLean v. Arkansas Board of Education – Decision by U.S. District Court Judge William R. Overton – January 5, 1982 (Last Update: January 30, 1996)
“On March 19, 1981, the Governor of Arkansas signed into law Act 590 of 1981, entitled ‘Balanced Treatment for Creation-Science and Evolution-Science Act’….” “On May 27, 1981, this suit was filed (1) challenging the constitutional validity of Act 590 on three distinct grounds.
First, it is contended that "Act 590 constitutes an establishment of religion prohibited by the First Amendment to the Constitution, which is made applicable to the states by the Fourteenth Amendment….”
(This decision cited U.S. Supreme Court Justice Black’s 1947 statement):
“The ‘establishment of religion’ clause of the First Amendment means at least this: Neither a state nor the Federal Government can set up a church. Neither can pass laws which aid one religion, aid all religious, or prefer one religion over another…. No tax, large or small, can be levied to support any religious activities or institutions, whatever they may be called, or what ever form they may adopt to teach or practice religion…. In the words of Jefferson, the clause…was intended to erect ‘a wall of separation between church and State.’” (pp. 1, 2 of 23)

Kitzmiller v. Dover Area School District: The ‘Intelligent Design’ Case – “Judge John E. Jones III issued his opinion and order on December 20, 2005, ruling that the teaching of intelligent design in public schools violates the Establishment Clause of the First Amendment. The ruling is a victory for the plaintiffs in the case.” (p. 1 of 1)
Edwards, Governor of Louisiana, et al v. Aguillard et al – U.S. Supreme Court Decision – [7-2 decision] (June 19,1987) (Last Update: November 6, 2005)
“The Supreme Court affirmed the judgment of the court of appeals, which in turn had affirmed the District Court’s decision finding the Louisiana act unconstitutional.” (p. 1 of 37)
“…The District Court granted summary judgment to appellees, holding that the Act violated the Establishment Clause of the First Amendment. The Court of Appeals affirmed.”

“Evidence Confirming That The Courts Have Concluded That
‘Creation Science’ Has A Religious Agenda And That ‘Evolution Science’
Is To Be Regarded As ‘Secular Science’’, Having No Religious Agenda”
As noted in the HB or SB Precis, this evidence is confirmed in the same documentation listed for SECTION 2. The only difference is that the emphasis here is on the clear statements in that documentation which stress the point that only “creation science” is regarded as “religious” and thus in violation of the Establishment Clause of the Constitution. Those statements are underlined
The unmistakable conclusion to be drawn from the Court’s characterization of “creation science” as religious and not secular, and thus in violation of the Constitution, is that “evolution science” is being characterized by the Courts as non-religious/secular and thus NOT in violation of the Establishment Clause.
We shall now see in SECTION 4 that “evolution science” is equally culpable with “creation science” of being in violation of the Establishment Clause because its roots are also demonstrably inseparable from the teachings in a certain “holy book” used by a certain religion and cannot, therefore, be secular as claimed.
“Evidence Here Confirms: a) That ‘Evolution Science’ Is Not Secular; b) That ‘Evolution Science’ Is A Religious Model Of The Origin Of All That Exists; c) That This Origins Model Is Dependent Upon Billions Of Years Of Evolution To Establish An Alternative ‘Creation Scenario’; d) That This Religious Model Is Ratified By The Pharisee Sect Of Judaism And Taught In the ‘Holy Book’ Zohar/Kabbala.”
By all accounts, the central concept of evolution theory is that all that exists has evolved to its present state over a time frame encompassing billions of years. Whether textbook, encyclopedia, internet facts, or other source, the dependency upon those billions of years to give evolution theory credibility is indisputable. The earth, for example, is said to 4.6 billion years old. The first evolving life form on earth is said to have begun c. 3.8 billion years ago. The moon is said to be c. 4 billion years old. The Appalachian Mountain Range is said to be Late Permian: “299-351 mya”(mil.yr.ago). The Alps: Middle Miocene: “23.8 mya”. Dinosaurs, we all learn, became extinct 65 million years ago (recently revised to 300 million years). Amphibians evolved c. 400 million years ago. Mankind evolved to its present state between 1 and 2 million years ago. NASA regularly reports on discoveries of new planets and galaxies, some 80% as old as the Big Bang itself, an age now established at some 15 billion years plus or minus a billion or so years.
Today, figures such as these are read and heard and taught and used in every public school and college in the USA (and globally) as scientifically accepted time frames for the evolutionary explanation of the Origin of all that exists in the universe and on earth.
We now survey the religious roots of evolutionism. Note these long hidden but now available facts:
“Nechunya ben HaKana, a 1st century Kabbalist asserted that if you know how to use the 42 letter name for God you could decipher a lengthy time between the creation of the universe and man. He estimated the age of the Universe at 15.3 billion years, some 2000 years ago, the very age modern astrophysics have just arrived at….”1 (Color emphasis added throughout)
“I show in my book (The Heavenly Time Machine: The First Six Days) procedures and commentary that lead to a universe age of between 14 and 16 billion years, depending on which procedure one chooses to follow. Some of these numbers can be traced back to the first century almost 2000 years ago. There is a deeply hidden knowledge in the Torah that yields these numbers….”2
“…Rabbi Aryeh Kaplan quotes R Yitzchak of Akko (a student of Ramban, late medieval) who concludes from the Zohar that the first creation was 15.8 billion years ago—the age astronomers and physicists seem to be converging on, given multiple ways of measuring the age….”3
“Let’s look at the development of time, day by day, based on the expansion factor [1 million times 1 million from start till now]. The calculations come out to be as follows:
it was 8 billion years.
Then you add it up [Kabbalist physicist Schroeder continues] and you get 15 ¾ billion years…the same as modern cosmology allows….”4
“Nachmanides the Kabbalist…says that although the days [of Genesis] are 24 hours each, they contain ‘kol yemot ha olam’—all the ages of the world…. Nachmanides says: There’s only one physical creation, and that creation was a tiny speck….As this speck expanded out, this substance—so thin it has no essence—turned into matter as we know it…. The moment that matter formed from this substanceless substance, time grabs hold…. Einstein’s…E=MC2, tells us that energy can change into matter. And once it changes into matter, time grabs hold….”5
“Nachmanides [13th century Kabbalist RabaN NOT RabaM] in his commentary of Parshat Beraishit says on the phrase ‘And it was evening and it was morning, one day” [Gen. Ch.1:5] that some scholars explain that ‘one day’ is a reference to the rotation of the spherical earth in 24 hours, and every moment there is a morning somewhere on earth and night in the opposite place. The scholars he is referring to are the Ibn Ezra’s commentary on this same verse and Rabam [Maimonides] Moreh Nebuhim, 2, 30....
This is amazing! Not only do we have here, the idea that the earth is a sphere and not flat, but that sunrise and sunset is [sic.] caused by the earth’s rotation, not by a moving sun,--many years [c.300 years before Copernicus] before science discovered this….”6
“Isaac Luria [1534-1572]…or ‘Divine Rabbi Isaac’, was, and remains to this day, unarguably the greatest Kabbalist in world history. His doctrines…anticipated virtually word for word—or at the very least, concept for concept—the theory of the ‘Big Bang’ origins of the universe in astrophysics….
Put simply, [Luria’s] doctrine of Sheviret HaKelim states (as does also 20th century Big-Bang theory) that the Universe (i.e., the Unity of God) was shattered at the moment of mundane creation. From this cataclysm, ‘Holy Sparks’ flew off in all directions, some returning to their Source, others falling into the world of ‘things’ and ‘beings’….”7
“…all these have passed into the realms of science and are no longer regarded as magical arts….”8
“According to kabbalistic wisdom, there are two parallel universes; one highly ordered; the other; random and chaotic. The former is real...the latter illusionary. ....In other words, we create our own reality by altering our consciousness.”9
Author Ziman tells us that Kabbalah and physics “…work together to draw a picture of the mysteries of such phenomena as the big bang, parallel universes, relativity theory, and the superstring theory.”10
Kabbalist Rav Berg says: “…Kabbalah can explain the mathematics of physics as well as providing a deeper spiritual comprehension of religion’s literal teachings….”11
In “Early Hebrew Mysticism”…there are several pages “…dealing specifically with letter mysticism and kabbalism…and describing the power of the Hebrew alphabet...and a practical guide for the creation of a golem12 Golems can be created using many different methods….”13 “…A golem will always be somewhat less than human.”14
Before going on to Section 5, a summary statement underscoring a major conclusion needs to be drawn from Section 4; to wit:
All of evolution’s essential concepts (15 billion years, relativity, heliocentricity, big bang, expanding universe)--which are now textbook “science”--are the same concepts that were formulated by Kabbalist “sages” in a mystical holy book as far back at least as the 1st century A.D and expanded in the 12th, 13th, 16th and 20th centuries.
However, until about a decade ago, the world outside the ultra-secret Kabbalist insiders has had no knowledge of this incredible collusion between the Kabbalic “creation scenario” of the Pharisee Sect of Judaism and the establishment of that Religious “creation scenario” under the guise of being secular theoretical science.

It is now known that the Kabbala, the most holy book the Religion of the Pharisees, is the source of all the concepts which make up today’s Big Bang "Origins Scenario", and it is that Scenario which provides the billions of years required by the “theory of evolution” which the Courts have heretofore viewed as “secular evolution science”.
In light of this long hidden but recently revealed and certified knowledge, it is obvious that the "Establishment" and "Separation" arguments that have been used by the Courts in the USA to thwart all challenges to “evolution science” in tax supported schools, must now be applied with the same force to thwart further deceptive teaching of the Pharisee Religion’s alternate “scenario” about the origin of all that exists with taxpayer's money.
The perfect resolution of the seemingly interminable debate over evolutionism in the USA is now within the grasp of the Courts, high and low. That resolution is reduced to only one option when the Constitution is observed. That option is this: Educate only with the known facts of science. If hypotheses and theories contradict known facts, the facts prevail and are to be taught as true science. Let those facts form each student’s conclusions about the Origin of the universe, the earth, and mankind, thus guaranteeing the lawful use of the public treasury.
